The NDP’s Declaration on the Rights of Indigenous Peoples Act — DRIPA — was passed with promises of transparency and predictability. Instead, it has created uncertainty, confusion, and risk across the province. The B.C. government itself says the Act is meant to align provincial laws with UNDRIP and allow shared or consent-based decision-making agreements.
Recent court decisions have exposed how serious this uncertainty has become. The City of Richmond has warned that the Cowichan decision could affect land ownership in areas covered by the ruling. The Gitxaala decision has also raised major questions about how DRIPA affects resource development, mineral claims, consultation, and provincial decision-making.
A Kerry-Lynne Findlay government will restore common sense, legal certainty, and fairness for all British Columbians.

Restore certainty for investment and jobs
Mining, forestry, energy, housing, farming, and infrastructure projects need clear rules, firm timelines, and one standard of law for all British Columbians.
Respect Indigenous rights through clear law, not confusion
Reconciliation must be based on respect, good-faith negotiation, economic partnership, and constitutional clarity — not legal uncertainty that divides communities and weakens public confidence.
Protect provincial decision-making
Major decisions over land, resources, permitting, parks, and public infrastructure must remain accountable to the elected government of British Columbia.
Pursue constitutional protection for property rights
Kerry-Lynne Findlay will work with Western provinces to seek constitutional reform that protects private property rights and restores certainty for families, businesses, and investors.
