Policy: Repeal No Fault

Policy: Repeal No Fault

Repeal ICBC's no-fault system. Restore rights. Put British Columbians first.

British Columbians were promised a simpler, cheaper “no-fault” system. Instead, many crash victims have been forced into a model where a government monopoly largely decides what support they receive - with limited ability to challenge unfair decisions. When someone suffers a serious injury, they deserve timely care, fair compensation, and a real right to independent review.

As Premier, Kerry-Lynne Findlay will repeal the NDP’s harsh no-fault ICBC insurance system and restore meaningful legal rights for individuals with injuries to pursue full and fair compensation in court, including for income loss and non-economic damages.

Policy Commitments:

  • Repeal no-fault and restore victims’ rights

    • Repeal the NDP’s no-fault framework and implement a fair system that respects the rights of motor vehicle accident victims.

    • Restore meaningful legal rights for individuals with injuries to pursue full and fair compensation in court, including for income loss and non-economic damages.

  • Guarantee timely care and recovery supports

    • Ensure immediate access to medical treatment, rehabilitation, and recovery services following a crash.

    • Establish clear ICBC claim service standards so benefits are delivered promptly, transparently, and consistently.

  • Protect the right to representation in court for all British Columbians

    • Ensure all injured British Columbians have meaningful access to legal representation, particularly for serious injury claims.

  • Strengthen accountability and transparency
    • Require public reporting on key performance measures, including claims timelines, dispute outcomes, and customer service standards.

    • Establish stronger oversight mechanisms to ensure the system serves drivers and accident victims - not bureaucracy.
